Variable Pricing

Variable Price products must be clearly defined and tied to a specific market index so the price can be verified each month for accuracy. Month-to-month pricing structures described as “managed” or “best efforts” should be avoided at all costs as they are the equivalent of writing a blank check to the seller. (Note that this applies to the definition of any “roll-over” pricing in a contract as well)
